This Privacy Policy (together with our Terms & Conditions and any other documents referred to in it) sets out the basis on which any personal information we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal information and how we will treat it. If you do not agree with the practices described in this Privacy Policy, please do not provide us with any personal information.

We respect your concerns about privacy and are committed to protecting it. This Privacy Policy describes the types of personal information we collect through the application for your mobile device (the “App”) provided to you by us, and our website at https://uk.merpay.com/ (“Website”) as well as all related web sites, networks, downloadable software, and other services provided by us and on which a link to this Privacy Policy is displayed (collectively, together with the App and Website, our “Service”) and describes the measures we take to protect the security of the personal information. It also tells you how to reach us to ask us to: (i) access, change or discontinue use of your personal information; (ii) withdraw consent previously provided to us to process your personal information; (iii) refrain from communicating with you about our Service; and, (iv) answer any queries you may have regarding our privacy practices.

This Privacy Policy does not apply to information collected by any third party, including through any third party content (i.e. advertising that may link or be accessible from or on the website).

Changes to this Privacy Policy: this Privacy Policy was last updated on the “Effective Date” noted below. Merpay reserves the right to change, modify or amend this Privacy Policy from time to time to reflect changes in our privacy practices. You are encouraged to review this Privacy Policy periodically and to check the “Effective Date” at the bottom of this Privacy Policy for the most recent version, to inform yourself about how your Personal Information is collected, used and shared when you use the Service. To the fullest extent under applicable law, your use of the Service after the “Effective Date” means you are subject to the Privacy Policy then in effect.

INFORMATION WE MAY COLLECT FROM YOU AND HOW WE USE IT

1. What personal information do we collect from you?

Information you provide to us

We request personal information when you use our payment system, answer a survey, enter a contest, correspond with us, engage in activities on the Service, or receive the Service. You make the decision whether to proceed with any activity that requests personal information. If you do not wish to provide the requested personal information, however, you may not be able to complete the payment.

・My Account - “Sign in to Merpay”

You may wish to register to create an account on this Service. To do so we may ask for information including your full name, email address, telephone number and a password. Alternatively, your account registration may be undertaken via a third party platform, such as Facebook or Google using your twitter handle, Facebook ID or Google+ ID.

・Making payment using our Service

If you use the Services and pay for purchase of a product using our Service, we will collect certain personal information about you in order for your order to be processed and fulfilled. This information may include your name, billing and shipping address information, email address, telephone number and payment card information.

・Redemption of sales amount

When you request to redeem your sales amount from your e-money account, we will collect certain personal information about you in order to transfer your sales amount to your designated bank account. This information may include your bank account information.

・Customer Due Diligence

When you use our Services, required by laws, we may perform due diligence procedures based on the collection of your name, date of birth, residential address, nationality, ID number such as passport, driver’s license. This information will be collected via us and/or third party vendor.

・Contests and Promotions

You may be able to participate in contests and promotions. If you choose to participate in these promotions, we may ask for information such as your full name, email address, confirmation of age bracket, Facebook ID, Google+ ID, postal address, and phone number. We use this information to administer our contests and other promotions.

Information we collect automatically or from third parties

When you use our Services, we collect and process usage data about your use of our Service such as how many users arrive, the length and frequency of stays, the types of browsers and computer operating systems used by our users and Internet Protocol (“IP”) addresses from which our users connect to our Service (meaning the address that identifies the device you use to connect to our Service). This information, combined with the details you have provided us with, enables us to customise your visits by gathering demographic information about you. It may also help us diagnose problems with our servers and software. You may object to the analysis of your anonymous browsing behaviour by us for marketing, market research or the adaption of the Service to your needs. In order to do so please set your browser settings to reject cookies before using the Service. We may also receive information about you if you use any of the other websites we operate or the other services we provide. We work closely with third parties(including, for example, our sister company Mercari Europe Ltd, business partners, sub-contractors in technical, payment and delivery services and advertising networks) and may receive information about you from them. We allow these third parties to obtain personal data for providing support services. Please note, our third party contractors may change from time to time as we continue to offer more services and continue to improve our offerings. Such third parties may have access to your personal data to provide services on our behalf, but may not use your information for any other purpose beyond what we direct them to do.

2. How do we use the information we collect?

We use personal information in the following ways:

  1. To facilitate payments between the users of the Mercari online marketplace in relation to the sale and purchase of goods and to provide e-money accounts and services. This will involve the transfer of your personal information (including financial data) between Mercari Europe, an online marketplace provider and us;

  2. To provide you – subject to your marketing preferences – with information about product upgrades, new products, services, newsletters, informative emails and research on future product ideas or improvements;

  3. To assist us in creating content that is relevant to you;

  4. To provide you – subject to your marketing preferences – with special offers that may be of interest to you;

  5. To invite you to participate in online surveys or give us product feedback online;

  6. To assist us in creating better products and services to meet your needs;

  7. To allow you to download documents, obtain access to services or otherwise engage in activities you select; and

  8. To help you quickly find software, services or product information important to you.

  9. To perform due diligence procedures required by applicable law. This will involve the transfer of your personal information among Mercari Europe Ltd, third party vendor and us.

  10. To process/store your personal information. This will involve the transfer of your personal information to third party vendors (such as Google etc)

You can object to a use of your personal information for marketing and market and opinion research.

Electronic Marketing

From time to time, we may send you marketing emails with information about new products and services, as well as newsletters relating to our product and services offerings to the extent you have consented to the receipt of such marketing emails or the sending of such marketing emails is otherwise permitted by applicable laws. If you sign up for our marketing email list or for the marketing email list for an affiliate brand, then you will be asked to provide your email address. If you do not wish to receive emails from us, then please click on the unsubscribe link provided in the email in question. Generally, we use information from our marketing and research communications in an aggregated and anonymised way.

You may choose to contact us via the designated form on the Service, whereby you may be asked for information such as your name, email address, postcode and telephone number. We use this information to respond to and communicate with you about your questions and comments.

3. How do we protect your personal information?

In order to guarantee the security of your personal information we have set in place a series of security measures and safeguards. Your personal information is stored on secure networks that may only be accessed by a limited number of persons holding special access rights and who undertake to respect and maintain its confidential nature. 4. Transfer of personal information to other countries

We may transfer the personal information we collect about you to countries other than the country in which you originally provided it (including outside the EEA) where necessary to allow your use of the Service. These countries may not provide for the same level of data protection as the country in which you provided the information. If you withdraw your consent to the processing of your personal data or its transfer outside the EEA, which you can do by using the contact details in Section 10, we may not be able to provide the full functionality of the Service or full use of the Service to you.

5. Who has access to your personal information and to what extent?

In addition to the companies mentioned and for the purposes described above (e.g. Mercari Europe Ltd in Section 2), we do not sell, trade or transfer your personal information in any form to third parties without informing you first and in accordance with the personal information protection legislation currently in effect. Your personal information may be transferred to outside contractors to provide services for us. They may be used to provide technical support. We require that these contractors keep your personal information secure and confidential. We also require that these contractors use personal information only on behalf of Merpay.

In order to improve our Service, we may include links to websites of third parties. We are not responsible for the privacy practices of these websites. We encourage you to read their privacy statements, as they may differ from ours.

6. Choices and opt-out

We provide a number of ways for you to review, edit or delete your personal information or to ‘opt out’ of receiving additional information from us. We may offer you these choices at the same time you give us personal information.

You may also review, update or delete your account by editing your account and profile settings in the registration area. To protect your privacy and security, we will take reasonable steps to verify your identity before granting access or making corrections.

7. Access and correction

Subject to applicable law, we provide you with access to personal information we have retained about you and the ability to review, correct, update, block or delete the information where it is inaccurate. Subject to applicable law, we may limit or deny access to personal information where providing such access is unreasonably burdensome or expensive under the circumstances. 8. Children

We do not knowingly collect personal information from children under 13. No-one under age 13 may provide any information to or on the Service. If you are under the age of 13, do not register on the Service or use the Services or provide any personal information to us, including your name, email address or any screen name or user name you may use.

If you are under 18 years old, you will require consent from a parent or legal guardian.

9. Transfer of Ownership

In the event that Merpay goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personal information will likely be among the assets transferred. If so, you will be notified via email and/or by way of a prominent notice on the Service which will be displayed for at least thirty (30) days with information regarding change in ownership, uses of your personal information, and choices you may have regarding your personal information.
